1. Acceptance of These Terms
These Terms of Use ("Terms") govern your use of the Local Marketry website (the "Site"), operated by Local Marketry ("Local Marketry," "I," "me," or "my"). By browsing, using, or purchasing anything through this Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms govern the Site itself. Purchases of the Local Growth System are governed separately by my Terms of Sale and Refund Policy, and my handling of personal information is governed by my Privacy Policy. Where these Terms conflict with a more specific policy on that exact topic, the more specific policy controls.
2. Definitions
I use a few defined terms consistently across this document and my other site policies:
- The Local Growth System (or "the System"): my self-paced, $397 marketing framework, delivered as downloadable files.
- Digital Products: the System and any other standalone downloadable materials I may sell now or in the future.
- Customer: someone who has purchased a Digital Product.
- Visitor or User: anyone browsing this Site who has not purchased anything.
- Materials: my intellectual property, including frameworks, templates, worksheets, diagnostic tools, videos, and all written or recorded content that makes up this Site and the Local Growth System.
3. Eligibility
You must be at least 18 years old to use this Site or purchase the Local Growth System. By using the Site, you confirm that you meet this requirement.
4. Using This Website
I grant you a limited, non-exclusive, non-transferable license to access and use this Site to evaluate and purchase the Local Growth System for your own business use. This license does not include any right to reproduce, resell, or exploit the Site or its Materials beyond that purpose.
Using this Site does not currently require creating an account or logging in. The Local Growth System is delivered as a direct download after purchase, with no login and no membership area.
5. Acceptable Use
When using this Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site, its systems, or any account
- Interfere with or disrupt the Site's operation, including through excessive automated requests, scraping, or bots
- Upload or transmit viruses, malicious code, or anything designed to damage or disable the Site
- Copy, reproduce, distribute, or create derivative works from the Site's Materials without my written permission
- Impersonate any person or entity, or misrepresent your affiliation with Local Marketry
- Use the Site or the Materials to build a competing product or service
6. Ownership of Content and Materials
Everything on this Site, including its text, frameworks, worksheets, videos, graphics, and the structure and presentation of the Local Growth System, is my intellectual property (referred to throughout my policies as "Materials") and is protected by copyright and other applicable law.
Purchasing the Local Growth System gives you a license to use it for your own business, as described in my Terms of Sale. It does not transfer ownership of the underlying Materials to you, and it does not give you the right to resell, redistribute, or use the Materials to build a competing product.
7. Purchases
Purchases made through this Site, including the Local Growth System, are governed by my Terms of Sale and Refund Policy. This document governs your use of the Site itself, not the terms of any purchase.
8. Third-Party Links and Services
This Site may link to or reference third-party websites, tools, or services, including Squarespace, Squarespace Payments, social media platforms, and AI Tools such as ChatGPT or Claude. I do not control and am not responsible for the content, policies, or practices of any third-party site or service. Your use of any third-party tool is governed by that provider's own terms, not these Terms.
9. No Warranty
This Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied. I do not guarantee that the Site will be uninterrupted, error-free, or secure, or that any information on it is complete or current. Educational, results, and no-professional-advice disclaimers specific to the Local Growth System are covered separately in my Disclaimers.
10. Limitation of Liability
To the fullest extent permitted by law, Local Marketry is not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, this Site. Nothing in this section limits any liability that cannot be limited under applicable law.
11. Copyright Complaints
If you believe material on this Site infringes your copyright, contact me at hello@localmarketry.com with a description of the work, its location on the Site, and your contact information. I will review legitimate claims and take appropriate action.
12. Suspension and Termination
I may restrict or suspend your access to this Site at any time, for any reason, including a violation of these Terms.
13. Changes to These Terms
I may update these Terms from time to time, for example, as my business or offerings change. If I make a material change, I will update the effective date at the top of this document. Continued use of the Site after a change constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles.
